These Terms of Use ("Terms") govern your access to and use of the website biofal.eu (the "Website") and the purchase of any products from us. Please read them carefully. By using the Website or placing an order, you agree to these Terms.

In these Terms, "we", "us", and "our" refer to BIOFAL, SIA. "You" refers to the person using the Website or placing an order. Our online store is hosted on the Shopify platform.

2. Definitions

  • Products — the food supplements and other goods we offer for sale on the Website.

  • Order — your request to purchase Products from us.

  • Subscription — a recurring order arrangement described in Section 8.

  • Consumer — a natural person acting outside their trade, business, or profession.

3. Acceptance and eligibility

By placing an Order, you confirm that:

  • You are at least 18 years old and legally able to enter into a binding contract;

  • The information you provide is accurate and complete;

  • You are purchasing for personal use and not for resale, unless separately agreed with us in writing.

If you do not agree with these Terms, please do not use the Website or place an Order.

4. Our products

Our Products are food supplements made from freeze-dried grass-fed beef organs. We take care to describe and picture our Products accurately, but minor variations in appearance, colour, or packaging may occur. Product descriptions, images, and packaging are for general information and may be updated from time to time.

5. Health and product disclaimer

Please read this section carefully:

  • Our Products are food supplements and are not medicines. They are not intended to diagnose, treat, cure, or prevent any disease or medical condition.

  • Food supplements should not be used as a substitute for a varied and balanced diet and a healthy lifestyle.

  • Do not exceed the recommended daily dose stated on the product label.

  • Keep out of the reach of young children.

  • If you are pregnant, breastfeeding, taking medication, or have a medical condition, consult a doctor or qualified healthcare professional before use.

  • The information on the Website is provided for general informational purposes only and does not constitute medical or nutritional advice. You should not rely on it as a substitute for professional advice.

6. Orders and formation of the contract

  • Placing an Order is an offer by you to purchase Products subject to these Terms.

  • After you place an Order, we will send an order confirmation email acknowledging that we have received it. This acknowledgement does not yet form a contract.

  • A binding contract is formed only when we send you a dispatch confirmation email confirming that the Products have been shipped.

  • We may decline or cancel an Order (for example, if a Product is out of stock, if there is a pricing or description error, or if we suspect fraud). If we cannot fulfil your Order after payment, we will refund you in full.

7. Prices and payment

  • Prices are shown in euros (EUR) and are the final price payable for the Products. BIOFAL, SIA is not currently registered for VAT; no separate VAT is added at checkout.

  • Shipping costs are additional (except where stated as free) and are shown at checkout before you confirm your Order. See our Shipping Policy for details.

  • Payment is taken at the time of Order through our payment provider [PAYMENT PROVIDER, e.g. Stripe / PayPal]. We do not store your full payment card details.

8. Subscriptions

We offer an optional monthly subscription for eligible Products. The subscription works as follows:

  • Discount: You receive 10% off the regular price of the subscribed Product on every recurring delivery, for as long as your subscription remains active.

  • Shipping: Standard shipping rates apply to subscription orders, the same as for one-time orders (for example, €4.99 to the rest of the EU). See our Shipping Policy for the full rate table.

  • Monthly delivery: We automatically prepare and ship your subscribed Product once every month.

  • Recurring payment: By subscribing, you authorise us (via our payment provider) to automatically charge your saved payment method the applicable discounted amount at the start of each monthly billing cycle, until you cancel. The renewal date is based on the date you started the subscription.

  • No minimum term: The subscription is open-ended and continues until cancelled. There is no fixed commitment period.

  • Managing your subscription: You can view and manage your subscription through your account on the Website, or by contacting us at hello@biofal.eu. 

8.1 Cancelling a subscription

  • You may cancel your subscription at any time, with no cancellation fee.

  • To stop the next delivery and payment, you must cancel before that cycle's renewal/billing date. Cancellations made after an order has already been processed will take effect from the following cycle.

  • Cancelling stops future deliveries and charges. It does not automatically refund a delivery that has already been shipped; the return conditions in Section 10 and our Return & Refund Policy apply to Products already sent.

8.2 Changes to subscription pricing

We may change subscription prices or terms. If we do, we will give you reasonable advance notice by email before the change takes effect. If you do not agree to the change, you may cancel your subscription before the new price applies.

8.3 Failed payments

If a scheduled payment fails, we may retry the payment and/or pause or cancel your subscription. We will contact you where appropriate so you can update your payment details.

8.4 Your withdrawal rights

Your statutory right of withdrawal (Section 10) applies to subscription deliveries in the same way as to one-time Orders, subject to the same conditions for sealed food supplements.

9. Shipping and delivery

We ship within the European Union only. Shipping costs, processing times, and delivery estimates are set out in our Shipping Policy, which forms part of these Terms. Risk in the Products passes to you on delivery.

10. Right of withdrawal and returns

As a Consumer, you have a statutory right of withdrawal within 14 days. Because our Products are sealed food supplements, they can only be returned if they remain unopened and sealed, for health and hygiene reasons. Full details, conditions, and instructions are set out in our Return & Refund Policy, which forms part of these Terms. This does not affect your rights where Products are faulty, damaged, or incorrectly supplied.

11. Faulty, damaged, or incorrect products

If a Product is faulty, damaged in transit, or not as described, you are entitled to a remedy under applicable EU and Latvian consumer law, which may include repair, replacement, or a refund. Please contact us at hello@biofal.eu as soon as possible so we can put things right.

12. Our liability

  • We do not exclude or limit our liability where it would be unlawful to do so, including liability for death or personal injury caused by our negligence.

  • We are responsible for foreseeable loss and damage caused by us. We are not liable for loss or damage that is not foreseeable, or for loss arising from your failure to follow the product label, recommended dosage, or the guidance in Section 5.

  • Nothing in these Terms affects your mandatory statutory rights as a Consumer.

13. Intellectual property

All content on the Website — including text, logos, branding, images, graphics, and design — is owned by or licensed to BIOFAL, SIA and is protected by intellectual property laws. You may not copy, reproduce, distribute, or use our content for commercial purposes without our prior written permission.

14. Acceptable use of the Website

You agree not to:

  • Use the Website in any unlawful or fraudulent way;

  • Attempt to gain unauthorised access to the Website or its systems;

  • Introduce malware or otherwise interfere with the proper functioning or security of the Website;

  • Scrape, harvest, or misuse content or data from the Website.

15. Availability of the Website

We aim to keep the Website available and running smoothly, but we do not guarantee that it will always be available or uninterrupted. We may suspend, withdraw, or restrict all or part of the Website for business or operational reasons.

16. Privacy and data protection

We process personal data in accordance with our Privacy Policy, which explains how we collect and use your information and forms part of these Terms.

17. Complaints and dispute resolution

Your satisfaction matters to us. If something isn't right with your order or your experience, please reach out to us first at hello@biofal.eu — we'll do our best to listen and put it right as quickly as we can.

If we're unable to resolve things together, you also have the right to seek independent help as a Consumer:

  • In Latvia, through the Consumer Rights Protection Centre (Patērētāju tiesību aizsardzības centrs, PTAC) — www.ptac.gov.lv; and

  • For purchases from another EU country, through the European Consumer Centres Network (ECC-Net).

18. Force majeure

We are not responsible for any failure or delay in performing our obligations where this is caused by events outside our reasonable control, such as natural disasters, strikes, carrier failures, or interruptions to power or telecommunications.

19. Governing law and jurisdiction

These Terms are governed by the laws of the Republic of Latvia. If you are a Consumer, you benefit from any mandatory protections of the law of your country of residence, and disputes may be brought before the competent courts as provided by applicable EU consumer law.

20. Changes to these Terms

We may update these Terms from time to time. The version that applies to your Order is the one in force at the time you place it. The "Last updated" date at the top shows the current version.

21. General

  • If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full effect.

  • These Terms, together with our Privacy Policy, Shipping Policy, and Return & Refund Policy, make up the entire agreement between you and us regarding your use of the Website and purchases from us.
